January 16, 2006 Lecompton City Council Minutes

7:00 P.M. Mayor Roy Paslay brought the City Council meeting to order. Council Members Mark Tunstall, Tim McNish, Ed Smith, Chuck Folks and Jennifer Jones were present. Justin VanWinkle, City Superintendent, Georgia Wingfield, City Treasurer, Sandy Nichols, City Clerk, Larry Hendricks, City Attorney, and Planning Commission members, Kathi Fair, Jimmy Wilkins, Nancy Howard and Bruce Liese were present.

Ed Smith motioned to approve the minutes of January 2, 2006. Tim McNish seconded the motion, vote was unanimous.
Check #5378 is to be voided and check #5417 is to remain as is. Chuck motioned to approve the bills. Ed seconded the motion, vote was unanimous.

Amy Paslay was not present.
Greg Bloom was not present.

Gail Tompkins was present. After discussion Gail agreed to have sewer connections not duct taped and within the City Code regulations, to have large propane tank removed, remove travel trailers.
Ed made a motion to adopt the Zoning Map, Figure 5, in the Comprehensive book as the Official City Map and to change the Zoning Map to fit the Comprehensive Map. Mark seconded the motion and the vote was unanimous.
It was agreed the City Council and Planning Commission would meet to discuss the subjects further.
Mark made a motion to allow Gail to continue as a Mobile Home Park until the City Council and Planning Commission could come to an understanding of terms with time limit of 6 months. Chuck seconded. Mark amended to the motion to,” allow Gail to continue use of travel trailers until the City Council and Planning Commission could come to an understanding of terms with time limit of 6 months. Ed seconded the motion and the vote was unanimous.

Representatives of the Planning Commission stated they are making a recommendation to not have travel trailers in Mobile Home Areas. Tim made a motion to accept the recommendation not to have travel trailers in the city. There was no second of the motion. The Planning Commission recommended to follow the Zoning and Comprehensive Books not to allow travel trailers in Mobile Home parks. Tim made a motion to follow the Zoning and Comprehensive Books and not allow travel trailers in Mobile Home parks. Ed seconded the motion and the vote was unanimous. Jennifer made a motion to send Gail Tompkins a letter informing her of the decision and give her until March 1, 2006 to have the travel trailers removed. Tim seconded the motion and the vote was unanimous.

Chuck made a motion to have Mayor Paslay sign contract with Government Assistance Service for Administration of Services for the 2006 CDBG Water System Improvements Project. Jennifer seconded the motion and the vote was unanimous.

There was discussion between City Council Members and Planning Commission members regarding the city furnishing some money for the Community Building work. Council members stated this would have to be discussed for the 2007 budget this spring.

Larry presented updated legal information on Seconded Street property zoning violations. Mark made a motion for the Mayor to sign the court document. Jennifer seconded the motion and the vote was unanimous.

After discussion regarding Nehrbass property and adjoining city property, Mark made a motion to have Kenneth Shetlar and their surveyor survey the property. Tim seconded the motion and the vote was unanimous.

There was discussion regarding a variance at Hastert’s location. Kathi with speak to Roger Bartels with the Board of Zoning Appeals as to what needs to be completed next.

The City Clerk is requested to send a letter regarding chickens on Whitfield.

Justin reported he has two pressure meters on the two master meters at the MLC. Master Meter A by the mail box had 40 lb of pressure after installation. Master Meter B on Seventh Street had 36 -37 lbs of pressure after installation. There was discussion of backflow valves needed on master meters. Jimmy Wilkins will share information he has with Justin.

Nancy Howard asked if money from the Recaptured Housing Monies could be used for the Community Building. The answer was no. Donna Crawford had been asked this question in the past. Nancy wanted to know if there was money in Parks and Recreation that could be used. The council stated there were needs for sidewalks and other things as well as the Community Building. These will be taken into consideration for the 2007 budget.

9:40 P.M. Chuck motioned to adjourn, Ed/Jenn seconded the motion, and vote was unanimous.
