Lecompton Planning and Zoning Commission

Approval of Minutes: January minutes were approved with one spelling correction. Paul motioned, Jeff seconded approval, approved unanimously.

October minutes were approved with two corrections – the meeting was called to order by Jen, and “Bruce suggesting” needs to be deleted. Jeff motioned, Darby seconded approval, approved unanimously.

Presentation of Requests and Petitions: None

Notices and Communications:
Jen reported on the Big Springs Quarry Conditional Use Permit. She and Jeff made an informal recommendation on behalf of the Lecompton Planning and Zoning Commission to approve the CUP. The CUP will be approved by the Lawrence/Douglas County Planning Commission pending owner compliance with recommendations from a number of agencies.

Reports of Standing and Special Committees: None

Old Business:
Jen reported on the hearing in which the Douglas County Board of Zoning Appeals refused to grant a Conditional Use Permit for a liquor license for The Woods. The BZA decision will stand unless appealed to the state. It’s not clear what type of game will be hunted, how the game will be kept, or what sorts of hunting/firearms will be allowed. Water supply is a big issue, also the P&Z commission wondered about the impact on other services like fire and law enforcement. If we attend the Lawrence/Douglas County Planning Commission with a quorum we will be able to vote and make a recommendation regarding the site plan.

Jen reported on lot split…

Jen described her conversation with John Riggs on January 15. There is a requirement that 2 members of our commission be from the township if we want control our Urban Growth Area (UGA), but it is unlikely that Douglas County will ever give us that control. The rest of the responses are attached into the minutes.

The township wanted to build two additional carports on its property on Woodson Avenue. The city wanted it surveyed to determine the property lines. It appears that a citizen neighbor has a drive partway through the township property. This creates some exposure for the township. If someone is injured on their property it could be a problem. The township doesn’t want to put a fence up but if they have to, they will. They won’t if the citizen with the driveway carries $300,000 in insurance and the township is the named insured.

Darby moved, Paul seconded that the changes to the bylaws be approved. Passed unanimously.

Susie moved, Paul seconded that we keep the P&Z commission membership to 7. Five voted for, one opposed. Passed.

New Business: None.

Roy Paisley appointed Jen to the Board of Zoning Appeals. Jen invites other P&Z members to take her place if they’d like.

Susie motioned, and Jeff seconded, to adjourn the meeting – approved unanimously.

Jennifer Smith adjourned the meeting at 8:40 p.m.
