ORDINANCE NO. 821

AN ORDINANCE ANNEXING CERTAIN LAND INTO THE CITY OF LECOMPTON, KANSAS.

WHEREAS, Jimmy A. Wilkins and Lori A. Wilkins (the “Owners”) are the record owners of certain land (“the Land”, described hereafter) which lies upon or touches the City of Lecompton’s boundary line and therefore adjoins the City in accordance with K.S.A. Supp. 2015 12-519(d); and

WHEREAS, on June 19th, 2017, the Owners filed a written petition for annexation with the City requesting that the Land be annexed into the City, said petition is attached hereto as Exhibit A; and

WHEREAS, all of the owners of the Land petition in writing for annexation of the Land into the City; and

WHEREAS, under K.S.A. 2015 Supp. 12-520(a)(7) and 2015 Supp. 12-520a(f), the City may annex the Land by adoption of an ordinance, without resolution, notice, or a public hearing; and

WHEREAS, the Governing Body of the City finds it advisable to annex the Land.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LECOMPTON, KANSAS:

SECTION 1. The City hereby annexes and makes a part of the City the following legally described Land, located in Douglas County, Kansas, to-wit:

Beginning at the Northwest corner of the Southeast Quarter of Section Three, Township 12 South, Range 18 East of the 6th P.M.; thence in an Easterly direction along said center of Section line a distance of 1196.71 feet to point of beginning; thence in a Southerly direction of 90º00’00” a distance of 300 feet; thence in a Easterly direction of 90º00’00” a distance of 150 feet; thence in a Northerly direction of 90º00’00” a distance of 300 feet; thence in a Westerly direction of 90º00’00” a distance of 150 feet to the point of beginning, in Douglas County, Kansas.

SECTION 2. The Clerk of the City of Lecompton shall cause a certified copy of this ordinance to be filed with the Douglas County Clerk, the Douglas County Register of Deeds, and the County Election Commissioner of Douglas County.

SECTION 3. If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance.

SECTION 4. This ordinance shall take effect and be in force after its adoption and publication in the official city newspaper, as provided by law.
