ORDINANCE NO. 832

AN ORDINANCE CONSENTING TO THE APPLICATION AND ENFORCEMENT OF THE ANIMAL CONTROL CODE OF DOUGLAS COUNTY, KANSAS WITHIN THE CITY LIMITS OF LECOMPTON, KANSAS AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH.

BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LECOMPTON, KANSAS:

SECTION 1. Pursuant to K.S.A. 19-101(a)(4) and in accordance with Douglas County Resolution No. 21-50, the City of Lecompton, Kansas hereby consents to the application and enforcement of Chapter 2 of the Douglas County Code (the “Animal Control Code”), as adopted by the Board of County Commissioners of Douglas County, Kansas on December 1, 2021 and as may be amended, within the City Limits of Lecompton, Kansas.

SECTION 2. The Sheriff of Douglas County, Kansas and said Sheriff’s deputies and any other Enforcement Officer with authority to enforce the Animal Control Code are hereby expressly authorized and granted jurisdiction to investigate and enforce violations of the Animal Control Code within the City Limits of Lecompton, Kansas.

SECTION 3. The Administrative Hearing Officer appointed to hear and adjudicate violations of the Animal Control Code is hereby expressly authorized and granted jurisdiction to hear, adjudicate, and enforce violations of the Animal Control Code within the City Limits of Lecompton, Kansas.

SECTION 4. The provisions of the Animal Control Code shall apply within the City Limits of Lecompton, Kansas in addition to the City’s other animal control ordinances or regulations. The election to have the Animal Control Code apply within the City Limits of Lecompton, Kansas shall not, by implication or otherwise, serve to repeal or invalidate any other animal control regulations applicable within the City.

SECTION 5. All ordinances or parts or sections of ordinances in conflict herewith are hereby repealed.

SECTION 6. If any section, clause, sentence, or phrase of this ordinance is found to be unconstitutional or is otherwise held invalid by any court of competent jurisdiction, it shall not affect the validity of any remaining parts of this ordinance.

SECTION 7. This ordinance shall take effect and be in full force and effect following its adoption and publication as provided by law.
