July 7, 2025 LECOMPTON CITY COUNCIL MEETING MINUTES
7:00 P.M. Mayor Jimmy Wilkins brought the Lecompton City Council Meeting to order at 327 Elmore St. Lecompton, KS. Council Members Troy Clark, Mary Jane Hoffer, Stephanie Confer, Steve Freeman and Owen Mallonee were present at roll call. City Attorney Jeff Heiman, City Facility Maintenance Employee Tyler Freeman, City Superintendent Ryan Davis and City Clerk Lynley Sanford were also present. Residents or township members present included Elsie Middleton, Norraine Wingfield, Paul Bahnmaier, Brenda Hastert, Steve Marino, and Benton Peugh,
Mary Jane Hoffer motioned to approve the meeting minutes from June 16th, 2025. Troy Clark seconded the motion.
Motion passed 5 yeas, 0 nays
Owen Mallonee motioned to approve the bills before the council. Troy Clark seconded the motion. Motion passed 5 yeas, 0 nays
Mayor Wilkins signed a proclamation, proclaiming the week of July 21st for Charitable Action Week recognizing DCCF impacts on charitable donations to the Lecompton community.
Attorney Jeff Heiman has corresponded with attorney for the school district David Cunningham. The school attorney is working through the 1st right of refusal requirement. Jeff is working on getting a title report. At this point in time, we are waiting on the school districts determination of the 1st right of refusal before moving forward.
Stephanie Confer motioned to approve the Memorandum of Understanding as written between the City and the Historical Society. And asked that the current document be provided to the historical society for approval. Steve Freeman seconded the motion.

Attorney Jeff Heiman provided information to the City Council regarding the request for private burial on private property outlining State and County regulations, which greatly leave the decision for private burial up to the municipality. The Council was provided the formal request submitted by Benton Peugh along with an email received by the city office not in support of the burial. The City Council discussed in open session.
Troy Clark motioned to approve the burial on private property at the location indicated at 642 Southcrest with the intention of the city council and the planning commission to write a conditional use permit regulations for zoning for this type of request, if there are ever any in the future. Stephanie Confer seconded the motion.
Motion passed: 3 yays – Stephanie Confer, Troy Clark, Steve Freeman.

1 abstain – Mary Jane Hoffer
It was asked that the City office provide a letter of approval for the burial to Benton Peugh for the mortuary as soon as possible.
City council reviewed a boundary line adjustment for 230 E. Woodson Ave. as the survey for the adjustment refers to documents for road boundaries and may affect road widths.
Surveyor Steve Marino presented his findings and survey documents.
7:10PM Troy Clark motioned to go into executive session for 10 minutes to consult with the City attorney. Mary Jane Hoffer seconded the motion

8:02PM – Mayor Jimmy Wilkins brought the city council meeting back into open session
Stephanie Confer motioned to recognize Ordinance no. 13 as a legal document, and the road widths and right of ways vacations are supported and can be legally represented. Troy Clark seconded the motion

City Superintendent Ryan Davis provided updates to the City Council regarding the following.
– Windows at Old Rural High-school. Still working on obtaining additional bids, waiting on 1 more bid, so they will be reviewed at the council meeting on 7/21.
– Master meter for influent water at the water plant has been replaced. Rock for 449 Whitfield has finished being installed. Aerator at lagoon, cell 2 was removed and repaired, will reinstall this week. Have scooped out and treated duck weed and sprayed for weeds. Jeff Lamfers with KRWA is coming out on Wednesday to look at the Lagoons. Seiferts flooring came back in to screw down the subflooring in the South West corner of the Ft. Titus room at Lecompton Community Empowerment building.
Lynley will be out of the office the week of 7/14/2025-7/18/2025, Penny Bahret is planned to cover the city office during office hours.

Resident Elsie Middleton made a statement to the City Council expressing disappointment regarding the approval of private burial.
New Business
– City Council discussed the Revenue Neutral Rate for the 2026 Budget year. Stephanie Confer motioned to exceed the Revenue Neutral Rate at 29.527. Steve Freeman seconded the motion.
Motion passed 5 yays, 0 nays.
– The City Office received a complaint about the grass height at 710 Simons, which has been a vacant house since March of 2015. The City Council discussed the current condition of the house.
Stephanie Confer motioned to send a letter to the home owner regarding the grass height violation and nuisance vegetation issue allowing 30 days to address the weed/grass issue and a second notice regarding the condition of the siding, soffits and roof indicating the structure appears to be unsafe and in dilapidated condition. Owen Mallonee seconded the motion

8:29Pm Mary Jane Hoffer motioned to go into executive session for 15 minutes to discuss personnel matters of non-elected personnel. Owen Mallonee seconded the motion.

8:56P – Mary Jane Hoffer motioned to go back into executive session for 10 minutes to discuss personnel matters for non-elected personnel requesting Ryan Davis stay in.
Troy Clark seconded the motion.

9:06P – Mayor Wilkins called the meeting back to order.
The Council proclaims that Ryan Davis now carries the official title of Lecompton Superintendent.
