ORDINANCE NO. 822
AN ORDINANCE AMENDING CHAPTER II, ARTICLE 1, SECTION 2-109 OF THE CODE OF THE CITY OF LECOMPTON, KANSAS, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LECOMPTON, KANSAS:
Article 1. Section 2-109 of the Lecompton City Code is hereby amended to read as follows:
2-109. KEEPING ANIMALS. It shall be unlawful for the owner, lessee, occupant or person in charge of any premises in the city to possess and maintain any animal or fowl within the city or permit to be maintained thereon any stable, shed, pen or other place where horses, mules, cattle, sheep, goats or swine, or undomesticated animals are kept. This provision shall not apply to:
(a) The maintaining of dogs which are regulated by Article 2 of this chapter;
(b) The maintaining of non-poisonous and non-vicious animals and fowl which are commonly kept as household pets, such as cats, hamsters, rabbits, parakeets, and comparable animals, when kept as household pets and in a safe and sanitary manner in accordance with Section 2-113 of this chapter;
(c) The transporting of animals through the city by ordinary and customary means;
(d) Existing owner of animals or fowl within the city limits may maintain those animals until there is a change in the ownership in the property, animals are removed for 365 days, or as long as the property is zoned agriculture;
(e) The keeping and maintaining of no more than two (2) horses on the premises, provided the following conditions are satisfied:
(i) The premises must provide a minimum of five (5) acres of land for each horse kept and maintained on the premises;
(ii) The owner, lessee, occupant or person in charge of the premises must establish and sustain setbacks such that no horse is kept and maintained within 300 feet of a neighboring residence; and
(iii) The owner, lessee, occupant or person in charge of the premises must provide written notice to the City prior to bringing the horse onto the premises.
(f) The keeping and maintaining of female chickens on the premises, provided the following conditions are satisfied:
(i) The number of female chickens that can be kept or maintained on the premises at any time shall be limited to one female chicken for every 500 square feet of the subject premises, rounded down, with the number of allowed female chickens capped at twenty (20) for the entire premises;
(ii) The premises must contain a coop or other similar shelter to reasonably protect the female chickens from predators. The coop or similar shelter shall be a minimum of three (3) square feet in size per female chicken if the chickens have an enclosed outdoor run, or ten (10) square feet in size per female chicken if the chickens do not have an enclosed outdoor run;
(iii) The female chickens must be kept in a safe and sanitary manner in accordance with section 2-113 of this chapter; and
(iv) The owner, lessee, occupant or person in charge of the premises must establish and sustain setbacks such that no coop or similar shelter shall be kept or maintained within five (5) feet of a neighboring property line.
