March 1, 2021 LECOMPTON CITY COUNCIL MEETING MINUTES
7:00 P.M. Mayor Jimmy Wilkins brought the Lecompton City Council Meeting to order at 327 Elmore St. Lecompton, KS. Council Members Tim McNish, Stephanie Confer, Mary Jane Hoffer, Matt Roberts and Owen Mallonee were present at roll call. The following were also present: City Clerk Lynley Sanford, City Superintendent Rance Roberts and City Attorney Jeff Heiman. Residents or township members attending at roll call included Jason Hoskinson and Scott Clement. Council meeting was live on Facebook, commenters included Deanna Posik, Susan Wood and Jack Oglesby.
Mary Jane Hoffer motioned to approve the meeting minutes for the February 16, 2021. Matt Roberts seconded the motion.

Owen Mallonee motioned to approve the bills before the council, Stephanie Confer seconded the motion.

KDOT update – Lecompton sidewalk loop was funded and approved by Kansas Department of Transportation. Jason Hoskinson was present from BG Consultants to review the materials for the approved transportation improvement plan.
Owen Mallonee motioned to accept the grant award from KDOT and to submit form 1302. Matt Roberts seconded the motion.

Stephanie Confer motioned to contract with BG Consultants for the KDOT project. Mary Jane Hoffer seconded the motion.

Mayor Wilkins asked if the City Council was okay with giving him the ability to make certain decisions during the KDOT project when they are time sensitive. The general consensus of the council was yes, that would be okay.
Alley concerns at 432 Elmore. Mayor Jimmy Wilkins read a letter from Deanna Posik regarding the alley. In Deanna’s letter she refers to prescriptive easement and then a cross access easement. Mayor Wilkins state we needed to find out if the prescriptive easement would be between the City and Deanna or between Deanna and her neighbors. Through Facebook live messaging, Deanna Posik commented first that it would be between herself and the city. A few minutes later she commented no, it would be between her and her neighbors. In the letter Deanna indicated that she had consulted with an attorney. The City Attorney asked that more information be found before any type of agreement was made. Ultimately, what does Deanna and her attorney foresee this proposed easement looking like? How would they describe it? Council will revisit this.
The City Council also asked Jason Hoskinson – the representative from BG Consultant, if his firm would be interested in surveying the alley to “stake out” the width. Jason said they do provide survey services, and there may be a possibility to roll in the cost of surveying this section of alley into the total cost of our sidewalk project.
City could consider purchasing land from Deanna that is the existing travel-way. The solution needs to be permanent and legal.
At this time the City Council asked that City Clerk Lynley Sanford scan the surveys of Deanna Posik and Burke and Susan Wood property’s to Jason at BG consultants. The City attorney will ask Lynley to gather more information from Deanna Posik and her attorney before moving forward.
It was discussed when the first $50,000 of expenses would be paid to BG Consultants. City Attorney Jeff Heiman referred to the contract between the City and BG Consultants where it outlines some monthly payments for services rendered.
A.G. Municipal insurance, policy reviewed for renewal. There was an overall increase of $600 to the policy.
Owen Mallonee motioned to approve for 1 year municipal insurance. Tim McNish seconded the motion.

Scott Clement asked the City Council if holding the flea market in downtown Lecompton would be okay on the same weekend as City Wide Yard sales – June 4th, 5th & 6th. The consensus of the council was Yes!
Rance Roberts
– Water main leak on East Third St. – Terry Breason assisted, so did Mayor Wilkins. There are many patches in that section of line. The whole line needs replaced. Maybe do this summer.
– Working with ESI on replacing or repairing the valve at the Rural Water Building.
– Water Tower and Water Plant communication is back to normal. The freezing cold temperatures affected the communication between the tower and plant. The transducer wasn’t functioning properly. But we did not run out of water, nor did our tower overflow. So we did okay. A lot of manually initiating of water production processes.
– Discussed heating options at water plant. Still discussing more options. Mayor Wilkins and Owen will look at more options.
– The City Lagoons are scheduled for inspection on Tuesday March 2nd.
Lynley Sanford
– Asked City Council if they would like accountant Jim Long to come in and review the 2020 audit. No unusual findings were found. The council asked that the audit be scanned and emailed to them and then they will decide.
Old Business –
– Review bids for repairs at PRIDE building. 2 bids were provided – Sanford Remodel and Wilks Electrical & Handyman.
Matt Roberts motioned to go with Sanford Remodel on the repairs. Owen Mallonee seconded the motion. Motion passed 5 yeas, 0 nays.
New Business –
– Electrical Inspection permit for Mobile Home Park lot 16C. Stephanie Confer motioned to approve the electrical inspection permit. Mary Jane Hoffer seconded the motion. Motion passed 5 yeas, 0 nays.
– Douglas County Public Works contacted us to see if we wanted to participate in the bid for chip n’seal work. The County needs the road list by March 12th. Road history – 2016 the North end of town was chip n’sealed; 2018 the South end of town was chip n’sealed. No chip n’ seal has been complted in 3 years.
Council agreed to just do the North end of town this year, and dead end of Clark street.
Street repairs in preparation of chip n’ seal should be added to next agenda. Also discuss contracting out some of the street repair.
