November 19, 2012 LECOMPTON CITY COUNCIL MEETING MINUTES

7:00 P.M. City Council President Jimmy Wilkins brought the Lecompton City Council Meeting to order at 327 Elmore, Lecompton, KS. Council Members Tim McNish, Mary Jane Hoffer, and Elsie Middleton were present. Mayor Mark L. Tunstall, City Superintendent Justin VanWinkle and Council Member Susie Hackathorn were absent. The following were also present: City Clerk Lynley Sanford, Part Time City Superintendent Cody Nichols, residents or township citizens: Lori Wilkins, Sandy Nichols, Troy Clark, and Cyndi Treaster

Mary Jane motioned to approve the November 05, 2012 City Council Meeting Minutes. Elsie Middleton seconded the motion.
Vote carried 4 yays, 0 nays

Elsie Middleton motioned to approve the bills before the council. Tim McNish seconded the motion.
Vote carried 4 yays, 0 nays

Troy Clark – approached the City Council about their decision regarding the drainage tube at 422 Boone St.
The City Council discussed the situation. City Superintendent Justin VanWinkle had provided some feedback to Council President Jimmy Wilkins. The tube extension would cost about $600.00 and the labor for excavating would be around $600.00. Depending on the work, the city may need to get a working easement. City Attorney Lee Hendricks had mentioned this at a previous meeting.
Troy Clark said he was open to a working easement if the city is to do some of the repairs – may need to obtain legal description of property and measurements.

Elsie Middleton motioned for the City of Lecompton to proceed with incurring the cost of extending the drainage tube and labor involved at 422 Boone St. with the understanding the property owner will pay for the labor of the backfill dirt being hauled in, all subject to the appropriate easement being established. Tim McNish seconded the motion. Motion dies 0 yays, 4 nays.

Elsie Middleton made a new motion for the City of Lecompton to proceed with incurring the cost of extending the drainage tube and labor involved at 422 Boone St. with the understanding the property owner will pay for the labor for hauling in the back fill dirt; occasioned by this one time exception because of a bankrupt construction company’s failure to comply with zoning. All matters in this motion are subject to obtaining the appropriate easement rights of the property, and the cost of labor and tube does not exceed $1200.00 which is the cost originally quoted. Mary Jane Hoffer seconded the motion
Vote carries 4 yays, 0 nays.

Old Business –
– Elsie Middleton brought up the DCCF grant that the members of PRIDE were applying for. Asked if any council members had any questions or concerns about the grant. At this time no one has any comment.

New Business –
– Ordinance #811 for the increase of the base water rate was reviewed.
– Tim McNish motioned that Ordinance #811 be approved to increase the base water rate charge. Mary Jane Hoffer seconded the motion. Vote carries 4 yay, 0 nays
– Discussion about the city water utility bill that is provided to PRIDE on a monthly basis. The bill was started to help in tracking estimated utility costs in the event a business wanted to rent the entire building. At this time, Cyndi Treaster from the PRIDE committee stated that the funds PRIDE has reimbursed to the City of Lecompton have not included utility bills (Gas, Electric or Water). After some discussion it was determined that since PRIDE is not reimbursing the City for the use of any of the utilities, than it is not hurting anything to have the water utility bill created.
• At the Dec 05, 2012 city council meeting, for the motion to approve these meeting minutes, Council woman Elsie Middleton requested that it be noted that PRIDE has included the cost of gas and electric utilities in the checks for reimbursement, they have only not included the cost of the water utility.

– CB – mildew in the Sheriff’s office on the north and northwest walls. The council discussed how to clean it; P/T Superintendent Cody Nichols is to use bleach/water mixture to clean and disinfect the wall, let the room air out, and paint Kilz over it. A Dehumidifier will be purchased and ran in the room to help reduce the moisture.

– Wednesday November 28th, a representative from Overfield Security Monitoring and an AT&T representative are scheduled to come out and look at the wiring in the former High School building. They will be touring with Bill Smith and Elsie Middleton, determining what wiring can be removed.

– Jimmy Wilkins brought about the discussion of increasing the Mayors pay. Our current Mayor comes in weekly to check on City business, is always available to deal with citizen issues, he attends various other monthly meetings to help encourage small business growth for our community (e-communities). The Council decided it was something that needed further review and will be revisited at the next council meeting.

8:12PM – Mary Jane Hoffer motioned to adjourn, Elsie Middleton seconds the motion. Vote carries 4 yays. 0 nays
