September 7, 2010 LECOMPTON CITY COUNCIL MEETING MINUTES

7:00 P.M. Council President Mark Tunstall brought the Lecompton City Council Meeting to order at 327 Elmore, Lecompton, KS. Mayor Paslay was absent. Council Members Tim McNish, and Jennifer Smith were present. 7:05 Council Member Christy Mallonee arrived. The following were also present: City Clerk Sandy Nichols, and City Superintendent Justin Van Winkle; residents Elsie Middleton, Opal Goodrick, Jeff Goodrick and Denzil Hackathorn; Kim Ens with Douglas County Health Department; Cara Hendricks and Brian Kingsley with BG Consultants, Inc.

Tim McNish made a motion to approve the August 16, 2010 minutes. Jennifer Smith seconded the motion and the vote passed 3 yeas, 0 nays.

Jennifer made a motion to accept Banks Construction pay request and change order. Tim seconded the motion and the vote passed 3 yeas, 0 nays..
Jennifer made a motion to approve the bills before them. Tim seconded the motion and the voted passed 3 yeas, 0 nays.
Council Member Mallonee arrived.

Kim Ens was present to present a Proclamation for National Preparedness Month. Tim made a motion to accept the National Preparedness Month September 2010 Proclamation. Christy seconded the motion and the vote passed 4 yeas, 0 nays.

Opal Goodrick was present to discuss water usage located at 430 Whitfield. Mrs. Goodrick stated she believes problems with a water line break and a hot water heater were caused from negligence of the contractor and city did not forewarn all residents of possible issues. Mrs. Goodrick would like to be reimbursed for the pressure regulator and anything over the normal $58.95 utility bill and any subsequent water bill over the normal usage. 100’ of water line had to be replaced, hot water heater blew up, and air conditioner motor flooded out do to water heater problem. Jennifer made a motion to accepted payment of the minimum water bill at this time. Christy seconded the motion and the vote passed 4 yeas, 0 nays. The council tabled discussion of the remainder of the billing until the next council meeting, September 20, 1020 when the attorney will be present.

It was noted that Denzil Hackathorn had told a couple of people his water is now good.

Back flushing has recently been done daily. It should be done about twice a week. Justin reported on the results of flushing of the water lines.

Public Comment: It was noted September 10, 2010 members of The United State Court of Appeals for the Tenth Circuit would be in Lecompton to visit Constitution Hall and the town.

Resolution 269 declaring the boundary of the city of Lecompton, Kansas was presented. Jennifer made a motion to approved Resolution 269 declaring the boundary of the city of Lecompton, Kansas. Christy seconded the motion and the vote passed 4 yeas, 0 nays.

Justin presented asphalt bids for Whitfield from Sledd’s to 7th Street. There was discussion regarding patching, applying for grant money to assist with overlaying project, and priorities. It was noted by Jeff Goodrick Whitfield had received 4” of asphalt from Woodson Ave to Greg Sledd’s location many years ago and is not as bad as the remainder of Whitfield. Brian Kingsley and Cara Hendricks shared information. Jennifer made a motion to patch Whitfield and apply for a grant to put toward Priority 1A, Whitfield from Woodson Ave. to 7th Street. Christy seconded the motion and the vote passed 4 yeas, 0 nays.

Justin reported the transmitter for Rural Water district will be delivered in approximately four weeks.
The old tower is to be demolished late September or early October. A letter was read from Howard Duncan regarding reasons to maintain the old tower. There was discussion regarding extra equipment that would be needed to utilize a the old tower, tower needs painting, foundations need repair. Mr. Hackathorn wanted to know if there were grants available to update the old tower. The city clerk will check with the grant writer. After discussion the council elected to proceed with the demolition of the tower as it was part of the grant agreement.

AA may use the CB Monday evenings. Because of past problems not involving AA, new keys have been made and are to be returned after each use.

Denzil Hackathorn wanted to know who the “Welcome to Lecompton” sign belonged to. He is tired of maintaining the grass/weeds around it. Mr. Hackathorn stated if it is not going to be maintained something could happen to the sing and he wouldn’t know anything. He was told the sign had been donated. The council stated the sign had been paid for with city funds. It was noted for a couple of years the Territorial Dates had been changed and that was donated. There was discussion that other residents in town had to mow/weed whip around signs that are in there yards.

8:50 P.M. Jennifer made a motion to adjourn. Christy seconded the motion and the vote passed 4 yeas, 0 nays.
